INTERNATIONAL PROCESS SERVICE

The process is simple since WeServeIt does all the legwork. You should be aware that International Service take longer than service in the United States due to varying customs and practices in other countries.

Knowing how to legally serve papers in a foreign country is important in making a successful service. There is more than one way to effect process. Every country, as well as each of our states, has its own legal requirements for the service of process. Some countries also have laws prohibiting private process service.

There Are Several Methods Of Service Abroad

Service of judicial documents through an international treaty or convention, such as the Hague Service Convention and the Inter-American Convention, is the formally recognized and recommended method. Once we are provided with a copy of the documents and address for service, WeServeIt takes care of the rest. We prepare the necessary treaty documents and facilitate service through the appropriate governing authority. We also provide an affidavit detailing the service in progress which can support a motion to extend, if necessary. We also provide required translations, where requested.

Informal methods of service are also available in most areas of the world where service by a non-attorney or private process server can be conducted. In general, if the country is not a signatory of an international treaty, service may be made by informal methods (similar to service in the United States). However, some countries such as Germany, Japan, Korea, China, Switzerland and Italy do not allow service by private process server and impose serious civil and criminal sanctions on those who violate their national sovereignty. The advantage to utilizing informal service, in nations where it is available, is often the timeframe for completing service.
